The current version of the rules for the 2012 Fox Moot is 4.1.
Problem
Clarifications
At the Supreme Moot Court for Intellectual Property Appeals, Kane would be the party appealing to restore the injunction, whereas Abel would be cross-appealing to restore the reduced damages award.
Oral Arguments:
The order of presentation would be Kane counsel 1 on appeal; Abel counsel 1 to respond; Abel counsel 2 to present cross-appeal, Kane counsel 2 to respond. There is no right of reply.
Rule 7.3 is amended accordingly, and Rule 7.1 (c) is therefore suspended for the 2012 Competition.
Written Arguments:
Kane sets out their main arguments for the appeal and defends the cross-appeal in their factum (the Fox Moot Committee has determined that even though Kane is the respondent for the cross-appeal, it makes things simpler to follow this format). Factum is exchanged with Abel (as per the factum exchange period), and Abel defends the appeal and sets out their main arguments for the cross-appeal.
